Requirements for Starting a Foreclosure

    The Note and Trust Deed In order to start a non-judicial foreclosure on a property in the state of California, there must be a Note and a Trust Deed.
    Reasons to Start a Foreclosure The main reason foreclosures are started is because the Trustor has stopped making payments. Other reasons include the Beneficiary making payments to a Senior Lien, Insurance, or Taxes.
    Payment Information In order for the Trustee to perform a foreclosure, payment information is necessary. This includes information about the note, such as the Principal Balance, the Interest rate, the Payment amount, the Late Charge amount (generally 10% of the Payment amount), the Grace Period (Usually ten days), the month of the first delinquent payment, and any payments to Senior Liens, Taxes, Insurance, or any other fees associated with the Trust Deed in question.
